Can you tell us what appears to be illegal in the last paragraph of the legal notice for the referendum vote? Look closely… 17

I thought this was just a typo last vote, but here it is one vote later and it is still there. Is it  an attempt to influence the vote (subtle, but now obvious)?

  1. In all my years of authoring town meeting and referenda warnings I’ve never seen anything like this! The wording is already is clear in that the answer to the question is going to be either “yes” or “no”. This added “ditty” may be trying to persuade the voter to cast a “yes” vote, since that word appears first. If that’s the case then it would likely be an election law violation. The actual ballot, if I remember correctly, has a “yes” or “no” box to fill in without that wording at the end. Perhaps this should be “checked out”.

  2. Want to bet that if this wording is found to be in error that the two “top dogs” won’t take any responsibility? My guess is that one of the poor secretaries in that office would become the “fall guy”!

  3. It’s not just the wording, it’s that YES is all in capital letters and No is split. Wow!
    Someone should forward this to a governing authority…

  4. Mr. Moore signed it and one can only assume he signed it after it was typed. The fault lies with him and him alone. I simply can’t believe anyone would be this stupid and arrogant. Granted, we all make mistakes, but this goes way beyond a mistake. Especially given the emotional aspect of this whole mess. Mr. Moore needs to be more careful than ever – he puts this Board, this Community and our schools at risk every time he speak, writes, basically makes a presence! I don’t believe he has it in him to be smart about all of this, he is far too arrogant. Why can’t Kent remove him?

  5. The fax notation at the top of the page clearly establishes that this document was faxed out of the “central office” so there shouldn’t be any doubt as to its authenticity. I did notice in the legal ad in the Lakeville Journal that both the “YES” and “NO” were in capitals letters, but the question remains if that “YES” or “NO” should have been included as part of the legal notice at all!

  7. Those who have their shorts in a knot over this matter should take a deep breath and relax. It is common to mention a positive before a negative. For instance “plus or minus” as opposed to “minus or plus” or “for or against” as opposed to “against or for”. To become waxed over something like this detracts from the the efforts to draw focus to the real issues that are motivating the voters.   8. I don’t think anyone has their “shorts in a knot” over this – just making some observations. One more to add to the list – the fax with the legal notice was send on 9.9.13, but the notice is dated with Moore’s signature on 9.12.13. This appeared in the Lakeville Journal on 9.12.13 and had to be submitted the previous Friday, 9.6.13, so Moore obviously didn’t sign it on 9.12.13. Maybe not a big deal, but it none-the-less shows a pattern of not paying attention to detail or not knowing what that detail is and that is certainly a matter for the administration. I’m sure that some would agree that isn’t very business-like and would have to wonder how far such non-attention to detail extends! All that had to be done was date the notice when it was signed, not make it appear that it was signed the day it was published!

  9. I completely agree with Craig. How does this compare to the real issues? Do we really want to spend time on something so insignificant and deter from the issues that are important? Who cares when it was signed? Maybe he approved it via email so it could be sent in to the paper on time. Maybe the date on the fax machine is wrong. But more important, it’s not important. This isn’t a witch hunt, it’s about the education of our children. I stand behind every no vote, but not this. We don’t need mountains out of molehills! We’ve got plenty of mountains to move as it is.

    And I am certain if anyone went through every document in our own “stuff” you’d find plenty of typos and insignificant, unintentional errors. If I had a dollar for every insignificant error on “legal” documents in the Falls Village town hall, I could have retired much earlier. Don’t open a closet that is no better than your own.

    Let it rest and stay focused on the issues at hand – the real issues.

  10. The legal notice could have been sent to the Journal on Friday, Saturday, Sunday or Monday. Been done many times. Maybe the date is supposed to be the publish date, not the signature date.?? So many more important items to discuss and fix. This is really silly.

  11. It’s not a mountain being made out of a mole hill! It is just being pointed out as another lack of attention to detail in the administration. Remember, this is a legal document that should be prepared correctly. What this document shows is the lack of commitment to the details from the top down. It may seem small, but with the following errors on a LEGAL DOCUMENT that is required to be LEGALLY POSTED to hold a referendum, all the “i’s” should be dotted and the “t’s” crossed correctly. To even have as small of a “mistake” as a YES and No, and to have the wrong time zone given shows a lack of attention to detail. It’s now obvious that they just insert the amount in on an earlier version of the budget. Yes, it’s a time saver, but with a new budget, a new legal warning should be typed up as well. Any LEGALLY BINDING DOCUMENT can be called into question in a court of law for such small inaccuracies. Its a classic symptom of the many problems in the administration of Region One.

  12. We live in the Eastern Standard time zone. Open the paper, what’s listed on the legal notices for time zone? Is every one of them wrong and illegal? The date does not identify the date he signed it, it’s not even under his name. Probably a footnote indicating the publish date. If they just insert the new amount and change nothing else, why is the time zone now incorrect? Or anything else for that matter.? I’m all for change and will vote no again, but it would be a chuckle for anyone who is asked to review this for legal reasons/typos. Go for change, not blood!

    • Geeze not going for blood here, its just an indication of lack of attention to detail! No one is looking for anyone to lose their job over this, it is just another small indication of a much bigger problem.

  13. Here, here… just vote the budget down. Everone knows by now they can not get anything right, even I make typos.

    • Here is the direct quote from the statute….”The vote on such amendment, question or proposal shall be taken by a “Yes” and “No” vote on the voting machine”… NOT ” YES” “No”. In addition the statute, word for word continues on…
      “The warning for such election shall state that a purpose of such election is to vote for the approval or disapproval of such amendment, question or proposal and shall state the section of the Constitution or of the general statutes or the special act under authority of which such vote is taken. The vote on such amendment, question or proposal shall be taken by a “Yes” and “No” vote on the voting machine. ( Yes and No, NOT YES and No). A definition for you to ponder, and the reason why the state statute, and law are so clear and important….

  14. Maybe none of this is important, but from what I’ve seen it is usually not paying attention to detail that begins the downward slide. And that I think does result in change. I think that details are important and the building blocks for a “case”; without the details you don’t have the case to make. If it weren’t for those who have put themselves out there for eons, meaning years, taking the time and effort to research and look at the details to build a case for change, the story right now might be different.
